Terms of Service

Version 1.0 Effective April 5, 2026

These Terms of Service govern access to HomeRing AI, a software platform that answers property inquiries, records calls, creates transcripts, routes leads, and provides account analytics for real estate professionals.

1. Service Description and Limits

HomeRing AI provides hosted software, voice workflows, AI-assisted responses, and dashboard tools. The service depends on third-party infrastructure, telecom networks, and AI model providers, so availability, latency, and feature behavior may vary. We target 99.5% monthly uptime for the core application, excluding scheduled maintenance, force majeure events, carrier outages, and third-party failures outside our reasonable control.

2. AI Disclosures

HomeRing AI is an automated assistant. It is not a licensed real estate agent, broker, attorney, lender, or fiduciary, and it does not provide legal, tax, appraisal, fair housing, or brokerage advice. Customers are responsible for supervising how the service is configured and used in their business.

AI-generated outputs are produced from listing data, prompts, caller inputs, and machine learning systems. They may be incomplete, inaccurate, delayed, or unsuitable for a specific transaction. Customers must independently review material statements before relying on them.

3. Caller Notice

Customers must ensure callers are informed that they are interacting with an AI-enabled assistant and that calls may be recorded or transcribed where required by law. Customers are responsible for their own consent and recording compliance obligations.

4. Acceptable Use

Customers may not use the service to violate law or rights of others, transmit unlawful content, engage in harassment, stalking, threats, fraud, spam, discrimination, or unfair housing practices, or attempt to reverse engineer, disrupt, or abuse the platform. Customers may not use the service to make decisions or statements that unlawfully discriminate based on protected characteristics.

5. Customer Data Ownership

As between the parties, the customer owns its uploaded listing data, caller contact information, transcripts, recordings, notes, and other customer content. The customer grants HomeRing AI a limited license to host, process, transmit, back up, analyze, and display that data as needed to operate, secure, support, and improve the service.

6. Improvement Data and Opt-Out

HomeRing AI may use service interactions, transcripts, prompts, and usage patterns to improve safety, quality, analytics, and model performance, unless the customer opts out by emailing hello@homeringai.com. We may continue to use de-identified or aggregated information that does not reasonably identify a customer or caller.

7. Billing, Renewals, and Refunds

Paid plans renew automatically until canceled. Fees, plan limits, and overage pricing are described at checkout or in the dashboard. Customers authorize recurring charges for subscription plans and any approved one-time charges. Except where required by law, fees are non-refundable after the applicable billing period starts; however, a customer may cancel future renewals at any time from the billing portal. Trial or pilot credits, promotional pricing, and custom agreements may have separate written terms.

8. Suspension and Termination

Customers may stop using the service at any time. HomeRing AI may suspend or terminate access for non-payment, security risk, legal compliance, or material breach. For 30 days after termination, customers may request a reasonable export of available account data unless retention is prohibited by law or needed for dispute resolution, fraud prevention, or legal compliance.

9. Confidentiality and Security

Each party will protect the other party's non-public business information using reasonable safeguards. HomeRing AI uses administrative, technical, and physical measures designed to protect customer data, but no service can be guaranteed perfectly secure.

10. Warranties Disclaimer

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, HomeRing AI disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted service, and accuracy of AI-generated responses.

11. Limitation of Liability

To the maximum extent permitted by law, HomeRing AI will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost commissions, lost data, or business interruption. HomeRing AI's aggregate liability arising out of or relating to the service will not exceed the fees paid by the customer to HomeRing AI during the 12 months before the event giving rise to the claim.

12. Indemnification

The customer will defend, indemnify, and hold harmless HomeRing AI and its affiliates, officers, and personnel from third-party claims arising from customer content, unlawful recordings, fair housing violations, misuse of the service, or violation of these terms. HomeRing AI will defend the customer against third-party claims alleging the hosted service infringes a U.S. intellectual property right, subject to customary exclusions for customer content, modifications, combinations, or misuse.

13. Dispute Resolution

The parties will first attempt in good faith to resolve disputes informally. If that fails, disputes will be resolved in binding arbitration on an individual basis, except either party may seek injunctive relief for misuse of intellectual property or confidential information. Class, collective, and representative actions are waived to the maximum extent permitted by law.

14. Changes to These Terms

We may update these terms from time to time. Updated versions will be posted on this page with a new version number and effective date. Continued use of the service after the effective date constitutes acceptance of the updated terms.
